TERMS AND CONDITIONS OF SERVICE
Terms and Condition of Service
These Terms and Conditions (“Agreement”) govern all services provided by Magic Genie Services (“Company,” “we,” “our,” “us”). By booking or accepting services, the client (“Client,” “you”) agrees to be legally bound by this Agreement.
Scope of Services
Services are limited strictly to the scope confirmed in writing via estimate, booking confirmation, invoice, or contract. Any additional services not expressly included are outside scope and subject to additional charges.
Estimates & Pricing
All pricing provided prior to service is an estimate only. Final charges may vary based on: Property size, Property condition, Level of buildup, Undisclosed hazards, Additional time required, Magic Genie Services reserves the right to adjust pricing where actual conditions materially differ from those disclosed.
Payment Terms
Payment is due upon completion of service unless otherwise agreed in writing. Failure to remit payment may result in: Late fees, Collection proceedings, Legal recovery of unpaid amounts, Suspension of future services. Client agrees to pay reasonable collection costs and legal fees if recovery action becomes necessary.
Client Responsibilities
Client agrees to: Provide safe and unobstructed access, Ensure utilities are functioning, Secure pets, Remove valuables and fragile items, Disclose hazardous or unsafe conditions. The Company is not responsible for damage arising from: Pre-existing defects, Improper installation, Structural issues, Deteriorated surfaces, Loose fixtures
Disclosure Requirement
Client must disclose: Mold, Biohazards, Pest infestations, Excessive pet waste, Severe buildup, Chemical sensitivities. Any unsafe conditions, Failure to disclose may result in immediate termination of service without refund.
Limitation of Liability
To the fullest extent permitted by Canadian law: Magic Genie Services shall not be liable for: Pre-existing damage, Normal wear and tear, Permanent staining Surface deterioration, Manufacturer defects, Electronics malfunction, Mechanical failures, Indirect, incidental, or consequential damages. Total liability shall not exceed the total amount paid for the specific service rendered.
Indemnification
Client agrees to indemnify and hold harmless Magic Genie Services and its employees from any claims arising from: Undisclosed hazards, Unsafe conditions, Client negligence, Third-party interference
Satisfaction Guarantee
Concerns must be reported within 24 hours of service completion. Client must allow the Company reasonable opportunity to inspect and re clean. Refunds are discretionary and not guaranteed.
Right to Refuse or Terminate Service
We reserve the right to refuse, discontinue, or reschedule service where: Conditions are unsafe, Staff are threatened or harassed, Payment is refused, Terms are violated, No refund is required in such circumstances.
Force Majeure
Magic Genie Services is not liable for failure to perform due to events beyond reasonable control, including: Weather, Power outages, Natural disasters, Government restrictions, Illness
